1. About these terms
These Terms of Service apply when you visit this website or buy from our online store. The store is operated by LoftRest™, 28 Artemis Dr, Cranbourne East VIC 3977, Australia (ABN: [ADD YOUR ABN HERE, OR DELETE THIS]). "We", "us" and "our" mean LoftRest™. "You" means anyone who uses this website or places an order.
By using this website or placing an order, you agree to these terms. If you don't agree, please don't use the website.
2. Your rights under Australian Consumer Law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Where these terms would otherwise conflict with those rights, those rights apply.
3. Products and health information
LoftRest™ is a comfort and relaxation product designed to support the neck during rest and sleep. It is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or medical condition.
Information on this website is general information only and is not medical advice. Talk to your doctor before using LoftRest™ if you are pregnant, have had neck or spine surgery, or have osteoporosis, a recent neck injury, rheumatoid arthritis, a known spinal condition or a circulation disorder. Always follow the instructions supplied with the product, and stop using it and seek medical advice if you feel sharp pain, numbness, tingling or dizziness.
We try to describe and show our products accurately. Colours and details may look slightly different on your screen.
4. Prices and payment
All prices are in Australian dollars (AUD) and include GST where applicable, unless stated otherwise. Shipping costs, and any import duties or taxes for international orders, are shown at checkout before you pay.
We may change prices at any time, but changes won't affect orders we have already accepted. If a product is listed at an incorrect price because of an obvious error, we may cancel the order and refund you in full.
Payments are processed securely through Shopify. We do not store your full card details.
5. Discounts and offers
Discount codes and offers apply only as described, while advertised, and cannot be combined unless stated. For example, the LOFTREST2PACK code gives 10% off when you buy 2 or more LoftRest™ pillows in one order. We may end an offer at any time, but this won't affect orders already placed.
6. Orders
Your order is an offer to buy. We accept it when we send you a shipping confirmation. We may refuse or cancel an order, for example if a product is unavailable, if we suspect fraud, or if there is an error in the price or description. If we cancel an order you have paid for, we will refund you in full.
7. Shipping
Delivery times and costs are set out in our Shipping Policy. Delivery times are estimates. Risk in the goods passes to you when they are delivered.
8. Returns and refunds
You can return LoftRest™ within 30 days of delivery if you change your mind, as set out in our Refund Policy. Faulty, damaged or incorrect items are covered under the Australian Consumer Law, as explained in our Refund Policy.
9. Reviews and other content you send us
If you post a review or send us content, you confirm it is honest, is your own, and doesn't break any law or anyone else's rights. You allow us to display it on our website and marketing, with your first name and city if you provided them. We may remove content that is unlawful, offensive or spam, but we will not remove genuine reviews because they are negative.
10. Using this website
You must not use this website for any unlawful purpose, try to gain unauthorised access to it, interfere with its operation, or copy its content for commercial use without our permission.
11. Intellectual property
The LoftRest™ name and logo, and the text, graphics and design of this website, belong to LoftRest™ or are used with permission. You may not copy or reuse them without our written permission.
12. Other websites
This website may link to other websites. We are not responsible for their content or privacy practices.
13. Liability
Subject to section 2, we are not responsible for loss or damage that was not reasonably foreseeable, or that results from using the product against its instructions or safety information. Nothing in these terms limits our liability where the law does not allow it to be limited, including your rights under the Australian Consumer Law.

How we collect and use your personal information is explained in our Privacy Policy.
15. Changes to these terms
We may update these terms from time to time. The version on this website when you place an order applies to that order.
16. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
